Terms of Service – PrintMyPad

Effective Date: August 05, 2025

Welcome to PrintMyPad! These Terms of Service (“Terms”) govern your access to and use of our website and services (the “Services”), including any transactions, user-generated content, and product purchases. The terms “we,” “us,” and “our” refer to PrintMyPad.

By accessing or using our Services, including placing orders, browsing content, submitting reviews, or uploading images, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not use our Services.

1. Custom Products & Uploaded Content

We specialize in custom-printed mouse pads and desk mats using images, prompts, or designs you provide. By uploading any file to our platform or submitting a custom order:

  • You represent and warrant that you own, or have the legal right to use, the content you upload.

  • You grant us a limited, non-exclusive license to use, print, reproduce, and modify your uploaded files solely for the purpose of fulfilling your order and resolving any related customer service issues.

  • We retain uploaded files for up to 30 days after fulfillment. Files are automatically deleted after this period and cannot be recovered.

We reserve the right to reject or cancel any order containing content that, in our sole discretion, is infringing, offensive, unlawful, or violates third-party rights.

2. Reviews, Photos & Promotional Use

By submitting a product review, uploading photos, or tagging PrintMyPad on social media, you grant us a royalty-free, worldwide, perpetual, sublicensable license to use, display, reproduce, and publish your content for:

  • Showcasing real customer photos on our website or product pages

  • Sharing on our social media accounts

  • Promotional materials, advertisements, or other forms of marketing

If you submit a custom design and we believe it would showcase well in our gallery, social media, or advertising, we may use it as an example — unless you request otherwise by emailing us at info@printmypad.com.

You retain ownership of all rights to your content. We will never sell your design or reuse it beyond the above marketing rights.

3. Order Acceptance & Fulfillment

All orders are subject to acceptance by PrintMyPad. We reserve the right to cancel or refuse any order at our discretion. Your payment must be processed before your order is accepted.

You are responsible for providing accurate order information. Once placed, custom orders cannot be changed or cancelled unless otherwise permitted by our support team.

4. Pricing, Taxes & Duties

Prices are shown in Canadian Dollars (CAD) unless otherwise stated. We reserve the right to adjust prices, discounts, and shipping charges at any time without notice.

Customers are responsible for all applicable sales tax, VAT, import duties, and customs fees. International customers should verify local laws and import regulations before purchasing.

5. Shipping & Delivery

All delivery timeframes are estimates and not guaranteed. We are not liable for delays caused by the shipping carrier, customs inspections, or other factors beyond our control.

Ownership and risk of loss pass to you once the package is delivered to the carrier.

6. Intellectual Property

All content on the PrintMyPad website — including logos, graphics, product mockups, and site design — is the intellectual property of PrintMyPad or our licensors.

Except for the custom content you upload, you may not copy, reuse, or distribute any material from our website without prior written consent.

7. Use of Services

You may only use our Services for lawful personal or internal business purposes. You must not:

  • Upload content that is illegal, infringing, offensive, or fraudulent

  • Interfere with the functionality or security of the website

  • Use our Services for any commercial reproduction, resale, or unauthorized distribution

We reserve the right to suspend or terminate your access for any violation of these Terms.

8. Third-Party Services

Our Services may use third-party tools, such as file upload apps or image enhancement services. These tools are provided “as is,” and we make no warranties regarding their operation or content.

Any use of third-party services is at your own risk and subject to their respective terms and privacy policies.

9. Shopify Platform

This store is powered by Shopify. All transactions and communications are between you and PrintMyPad. Shopify is not liable for product quality, refunds, or any disputes arising from your order.

10. Disclaimer of Warranties

We do not guarantee that our Services will be uninterrupted, timely, or error-free. All content and services are provided “as is” without warranties of any kind, express or implied.

We disclaim all warranties of merchantability, fitness for a particular purpose, or non-infringement to the fullest extent permitted by law.

11. Limitation of Liability

To the fullest extent permitted by law, PrintMyPad shall not be liable for any indirect, incidental, punitive, or consequential damages, including lost profits, arising out of or related to your use of the Services or any products.

12. Indemnification

You agree to indemnify and hold harmless PrintMyPad and its affiliates, contractors, and employees from any claims, losses, or damages arising from:

  • Your use of the Services

  • Your uploaded content

  • Your breach of these Terms or violation of any law or rights of a third party

13. Governing Law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada. Any disputes shall be resolved in the courts of Ontario.

14. Modifications

We reserve the right to update or modify these Terms at any time. Material changes will be announced on our website. Continued use of the Services constitutes your acceptance of the revised Terms.

Customer Content, Artwork and Reviews

Your rights and permissions. When you upload, submit, send, or otherwise provide artwork, photographs, logos, text, designs, reviews, review photos, or other content (collectively, "Customer Content"), you represent and warrant that you own the Customer Content or have all licences, permissions, consents, and other rights necessary for PrintMyPad to receive, reproduce, edit, print, fulfil, display, and otherwise use it as described in these Terms. This includes any copyright, trademark, privacy, publicity, personality, and other third-party rights. You must not submit Customer Content that is unlawful, misleading, defamatory, infringing, or that you are not authorized to use.

Licence to PrintMyPad. You grant PrintMyPad a worldwide, non-exclusive, royalty-free, sublicensable, and transferable licence to host, store, reproduce, adapt, crop, resize, colour-correct, prepare, print, photograph, and otherwise use Customer Content as reasonably necessary to provide and support your order, maintain quality-control and transaction records, prevent fraud, resolve disputes, and comply with law. If you submit a review, review photo, testimonial, or other content for publication, or otherwise agree that content may be featured, this licence also permits PrintMyPad to display, distribute, reproduce, adapt, and use that content in our storefront, social channels, advertising, and other marketing. You may ask us to stop future marketing use through our contact page; removal may not affect uses already published, printed, legally required, or retained for legitimate order and recordkeeping purposes.

Reviews and gallery presentation. Reviews must reflect the reviewer's genuine experience. When a photograph is presented as part of a specific customer review, PrintMyPad will keep that photograph associated with the review that supplied it. Production and final-quality-control photographs may appear separately alongside general verified customer feedback and do not necessarily depict the reviewing customer's order. We may edit Customer Content for length, formatting, accessibility, or display, but will not materially change the meaning of a review.

Third-party artwork and non-affiliation. Customer Content may contain third-party characters, brands, logos, or artwork supplied at the customer's direction. Their appearance does not imply that PrintMyPad owns that content or is sponsored by, affiliated with, or endorsed by the relevant rights holder. The customer remains responsible for obtaining any permission required for the requested use.

Refusal, removal, and takedown. PrintMyPad may refuse to print, publish, or continue using Customer Content, and may remove it from our services, when we reasonably believe it violates these Terms, applicable law, platform rules, or another person's rights. Rights holders and authorized representatives may submit a copyright, trademark, privacy, or other content complaint through our contact page or by emailing info@printmypad.com. Please identify the protected work or right, the challenged content and its location, your contact information, and a good-faith statement explaining your authority and concern. We may ask for additional information and may restrict or remove content while reviewing a complaint.

Responsibility and indemnity. To the maximum extent permitted by applicable law, you agree to indemnify, defend, and hold harmless PrintMyPad and its owners, employees, contractors, service providers, and affiliates from claims, liabilities, damages, losses, and reasonable costs (including legal fees) arising from Customer Content you provide, your requested use of that content, your breach of the warranties in this section, or your violation of another person's rights. This section does not limit any non-waivable rights or remedies available under applicable consumer-protection law.
